Definitions and Interpretation

In these Terms and Conditions:

• "Bequesta", "we", "us", or "our" refers to Bequesta, a business operating from 56 Thanon Phang Nga, Talat Yai, Mueang Phuket, Phuket 83000, Thailand.
• "Client", "you", or "your" refers to any individual or family who engages Bequesta's services or uses our website.
• "Services" refers to any of the educational, facilitation, or administrative services offered by Bequesta, as described on our website and in any service documentation provided to you.
• "Website" refers to the site hosted at bequesta.biz.

Nature of Services

Bequesta provides the following services:

• Heritage Storytelling Session — a guided group session helping families capture and organise personal and family stories using structured prompts and simple recording methods. This is a memory and education service only.
• Document Organisation Toolkit — an administrative service assisting families to inventory and arrange their own personal records using templates and a structured system. This service organises the client's own materials only.
• Succession Education & Facilitation Program — an educational programme covering general succession and record-keeping concepts in plain language, combined with neutral facilitation support for family discussions. Content is educational and facilitative only.

None of the above services constitutes legal advice, financial planning, estate planning, tax advice, asset management, or any other regulated professional service. We do not act as your legal or financial representative in any capacity.

Engaging Our Services

An engagement with Bequesta begins when:

• You submit an enquiry and we confirm our availability and service details to you in writing, or
• You make a payment for a specific service

We will provide you with a clear description of the service, any materials included, the session format, and the price before any engagement is confirmed. You are under no obligation to proceed until you are comfortable with the terms of the service.

Fees and Payment

Service fees are as set out on our website and in any written confirmation we provide. All prices are stated in Thai Baht (฿) and are inclusive of applicable taxes unless stated otherwise.

Payment terms will be communicated to you at the time of booking. We reserve the right to update our fees from time to time; changes will not affect engagements that have already been confirmed in writing.

Fees paid are non-refundable except in the circumstances described in Section 5 below.

Cancellation and Rescheduling

We understand that circumstances change. Our cancellation approach is as follows:

• Cancellation by the client with more than 7 days' notice — we will offer a full credit toward a future session or, at our discretion, a refund.
• Cancellation by the client with less than 7 days' notice — we will endeavour to reschedule the session at a mutually convenient time. A credit may be offered at our discretion depending on the circumstances.
• Cancellation by Bequesta — if we are unable to deliver a session for any reason, we will notify you promptly and offer a full reschedule or a full refund.

Rescheduling requests are always welcomed where notice is provided. We aim to accommodate changes wherever reasonably possible.

Client Responsibilities

To allow us to deliver our services effectively, we ask that clients:

• Provide accurate and complete information when requested
• Ensure that appropriate participants attend agreed sessions
• Treat session facilitators and other participants with consideration and respect
• Understand that our services are educational and administrative in nature and do not replace independent professional advice
• Take responsibility for any decisions made based on materials or discussions from our sessions

Intellectual Property

All materials provided by Bequesta as part of our services — including workbooks, templates, prompt cards, recording guides, and facilitation materials — are provided for your personal and family use only.

You may not reproduce, distribute, sell, or adapt our materials for commercial purposes without our prior written consent. These materials remain the intellectual property of Bequesta except where otherwise stated.

Confidentiality

We recognise that our services often involve personal and sensitive family information. We treat all information shared with us in confidence and will not disclose it to third parties except as described in our Privacy Policy or as required by law.

In group sessions, we ask all participants to respect the confidentiality of information shared by others in the session.

Limitation of Liability

Bequesta provides all services in good faith and with reasonable care. However, given the educational and facilitative nature of our work:

• We make no representation that our services will produce any particular outcome for your family's affairs
• We are not responsible for any decisions made by clients based on information or materials provided through our services
• We are not liable for any loss or consequence arising from reliance on our services as a substitute for professional legal, financial, or tax advice

Nothing in these terms limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under Thai law.

Use of Our Website

You are welcome to browse our website for your own personal and non-commercial use. You must not:

• Use the website in any way that is unlawful or that may harm, disrupt, or interfere with its operation
• Attempt to gain unauthorised access to any part of the website or its underlying systems
• Reproduce or redistribute website content without our permission

Our website is provided on an "as is" basis and we cannot guarantee it will always be available or error-free. We may update or withdraw content at any time without notice.

Governing Law

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising in connection with these terms or our services shall be subject to the non-exclusive jurisdiction of the courts of Thailand.

We may update these Terms and Conditions from time to time. Updates will be posted on this page with a revised "Last updated" date. We encourage you to review this page periodically. Continued use of our services after any update constitutes your acknowledgement of the revised terms.
